1. Acceptance of Terms

By accessing and using LocalBH ("the Website"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please refrain from using the Website.

2. Personal Data Collection and Use

LocalBH complies with Bahrain's Data Protection Law for the collection and processing of personal data. By using the Website, you consent to the collection, use, and disclosure of your personal information as outlined in our Privacy Policy.

3. User Registration

Certain features of the Website may require user registration. You agree to provide accurate and current information during the registration process and to update such information to keep it accurate and current.

4. Ticket Purchase and Usage Policy:

a. Refunds and Exchanges:  Tickets purchased through LocalBH are non-refundable, except as outlined in our Refunds Policy. Exchanges are only allowed in limited circumstances as detailed in our Refunds Policy.

b. Ticket Transfer and Resale: - Tickets are non-transferable to third parties, except for immediate family members and never for a value exceeding the original purchase price. - Reselling tickets for commercial gain at a price higher than the original purchase price is strictly prohibited. Violation of this policy will result in ticket cancellation without a refund.

c. Event Entry and Attendance Guidelines:

Entry Restrictions:

Customers must check for any entry restrictions, including age or dress code limitations, before purchasing a ticket. LocalBH is not liable for ticket refunds if entry to the event is declined by the Promoter for reasons such as failure to meet dress code requirements, age restrictions, or engaging in disruptive behavior.

Rules and Regulations:

Tickets are subject to the Rules and Regulations of the venue and the event. Customers are responsible for understanding and adhering to these guidelines before purchasing a ticket.

 

Right of Entry and Searches:

The Promoter and venue management reserve the right of entry and may conduct security searches at any time to ensure safety and security at the event.

Ejection Policy:

If a Customer is ejected from an event by the Promoter, its agents, or venue management, no refund will be issued under any circumstances.

No Re-entry Policy:

Some venues enforce a strict "no re-entry" policy. Customers leaving the venue during an event may not be permitted back using their original ticket. No refunds will be issued for customers refused re-admission due to the no re-entry policy.

5. Restricted Items:

Venue management or the Promoter may restrict items brought into the event. LocalBH will not refund ticket purchases if entry is declined or ejection occurs due to possession of restricted items. LocalBH does not assume any responsibility for any items confiscated by the Promoter or venue management.

Liability and Safety:

LocalBH, venue management, and the Promoter are not liable whatsoever for lost or stolen items or injuries incurred at the event.

Attendance Responsibilities:

Customers must attend the event at the correct time on the correct date. LocalBH is not responsible for losses incurred due to the Customer failing to check the event details before traveling.

Cancellation or Postponement:

If an event is cancelled or postponed, LocalBH may offer a refund based on the Refunds Policy. Failure by the Customer to attend an event for any reason other than cancellation or postponement of the event will not be grounds for a refund.

Late Entry and Last Admission:

Customers must arrive on time, as some venues may refuse entry to latecomers. It is the responsibility of the Customer to know and adhere to the last admission time.

Photographic and Recording Equipment:

Most venues prohibit the unauthorized use of photographic and recording equipment. Customers should check with the Promoter and venue before arriving at the event.

Photography and Recording Consent:

By purchasing a ticket through LocalBH, you agree to be photographed, filmed, or recorded at the event. You waive all rights to recorded material and grant LocalBH, the Promoter, and venue management the right to use such material unconditionally without restriction or compensation.

6. Ticket Delivery and Collection Policy

a. Electronic Ticket Delivery: LocalBH issues purchased Tickets electronically as PDF files via email. It is the Customer's responsibility to:

i. Provide LocalBH with a working, correct email address for Ticket delivery.
ii. Check their Inbox for the email containing the PDF of the Ticket.

b. Alternative Delivery Method (Optional):

c. Ticket Exchange for Printed Ticket:

  • For a limited number of Events, the electronic PDF Ticket issued by LocalBH via email may need to be exchanged for a printed ticket issued by the Promoter. Collection booths for exchanging Tickets are usually situated close to the Event entrance.
  • In such cases, the Promoter or LocalBH will request the Customer to provide the following items to exchange the electronically issued Ticket for the printed ticket: i. A printed copy of the electronic Ticket or the Ticket number (mandatory in all cases) ii. One of the following forms of identification (original, not a copy required): - Valid photo identification document issued by a government organization, such as a driving license - Valid National Identity Card - Valid Passport

d. Printing Electronic Tickets:

  • Electronic Tickets purchased can be printed at any time from the "My Calendar" section of the Website provided the Customer has logged into their account.



Refund Guarantee Service Policy

Our Refund Guarantee service is designed to offer our customers peace of mind and protection under specific circumstances. Below are the conditions under which full or partial refunds are granted, along with important procedural notes regarding the refund process.

Eligible Circumstances for Refund:

  • Event or Attraction Cancellation: Full refunds are available if the event or attraction you have tickets for is completely cancelled.
  • Flight Alterations: If your flight is cancelled or significantly altered by the airline before the date of the event, you may be eligible for a refund.
  • Emergencies: Refunds may be granted for emergencies that prevent attendance, such as intensive care confinement, car accidents, childbirth, or serious injuries requiring hospitalization.

Important Notes:

  • Refund Request Timeline: All requests for refunds must be submitted within 7 days following the event date.
  • Processing Time: Refund processing will be completed within 20 working days after receiving the refund request.
  • Ticket Validity: Only tickets that are still valid and have not been used or scanned at the event will be considered for a refund.
  • Required Documentation: Applicants must provide copies of official certificates, identification, and proof of the claimed reason for a refund.
  • Refund Limit: Except for cases of cancelled events or attractions, refunds are limited to USD 300 per order or transaction.
  • Documentation Requirement: Refunds will only be issued for tickets covered by the necessary supporting documents.
  • Service Fee: The refund guarantee service fee is non-refundable.
  • Refund Restrictions: Refunds are not permitted outside of the reasons listed above.

5. Limitation of Liability:

In no event will LocalBH or its Event organizers, suppliers, advertisers, and sponsors be liable to the Customer  or any third party for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the Website, its content, or any product or service purchased through the Website. This waiver includes damages resulting from contract breach, tortious conduct, or any other legal or equitable theory, even if LocalBH has been advised of the possibility of such damages.

Without limiting the foregoing, Customers acknowledge and agree that LocalBH shall not be liable for:

  • Any failure of another user to conform to codes of conduct;
  • Personal injury or property damage resulting from your access to and use of the Website;
  • Unauthorized access to or use of secure servers and/or personal information stored therein;
  • Bugs, viruses, worms, trojan horses, or other destructive items transmitted to or through the website;
  • Errors, mistakes, inaccuracies, or omissions in any content; or
  • Lost, stolen, or damaged tickets, or the failure of a venue to honor a ticket.

The Customer’s sole remedy for dissatisfaction with the Website is to cease use. The limitations in this section apply even if any limited remedy fails of its essential purpose. Our aggregate liability under the terms or the use of the Website will not exceed one hundred United States Dollars (USD $100). In no event will attorneys' fees be awarded or recoverable. Our liability is limited to the fullest extent permitted by applicable Bahraini law.

6. Indemnification:

If a claim arises related to the Customer’s use of the Website, content, or user content, or your violation of the terms, the Customer agrees to indemnify, defend, and hold LocalBH and its affiliated companies, Event organizers, suppliers, advertisers, and sponsors, and each of their officers, directors, employees, and agents, harmless from any claims, damages, losses, and expenses, including reasonable legal fees and costs. LocalBH reserves the right to take exclusive control and defense of any claim, and Customers will cooperate fully in asserting available defenses.

7. Ticket Purchases and Transactions:

a. LocalBH as an Agent: LocalBH acts as the agent for various entities providing Events, including artists, venues, teams, fan clubs, promoters, and leagues (collectively referred to as the "Event Organizer"). While LocalBH primarily sells tickets on behalf of the Event Organizer, in rare instances, LocalBH may own a limited number of tickets as part of its contractual agreement with the Event Organizer.

b. Resale Tickets: If the Customer acquires a resale ticket through the LocalBH Website, the Customer  is buying from either a reseller (e.g., fans, season ticket holders, or professional resellers) or, in specific cases, directly from the Event Organizer. Tickets obtained from unauthorized sources, not through the LocalBH  Website, may be void, lost, stolen, or counterfeit.

8. Pricing, Availability, and Transactions:

a. Ticket Prices and Seating: LocalBH does not set ticket prices or determine seating locations, as these are typically determined by the Event Organizer. Face values of tickets are established by the Event Organizer, and tickets are distributed through various channels, including Websites, apps, and box offices. Ticket availability is subject to the discretion of the Event Organizer and may sell out quickly for popular events. Additional tickets may occasionally become available, but LocalBH does not control this inventory or its availability.

b. Errors and Fees: LocalBH is not responsible for typographical or system errors within the inventory listed for sale. In the event of an error during order processing, Customers will be notified, and a substitution will be made at no additional cost, or a refund will be issued. Please carefully review your tickets upon receipt, and contact us with any concerns. LocalBH may charge fulfillment, shipping, service, or other fees for its services, and these fees are subject to change at any time, even after ticket posting.

9. Use and Handling of Personal Information:

a. Collection and Purpose: LocalBH collects and processes Customers’ personal information for various purposes, including:

  • Facilitating use of the LocalBH services and Website.
  • Processing orders submitted through the Website.
  • Delivering purchased products and updating you on delivery status.
  • Verifying information accuracy through third-party comparison.
  • Administering your account, carrying out financial transactions, and auditing data downloads.
  • Enhancing website layout/content, customizing user experiences, and conducting demographic research.
  • Providing information about LocalBH's or third-party sellers' products and services, subject to your consent.
  • Sending marketing/promotional materials, newsletters, and related communications.

b. Disclosure and Sharing: LocalBH may share Customers’ personal information with third parties, affiliates, and official entities for transaction completion, account management, marketing, and legal/regulatory compliance. Specific government entities in Bahrain, may require the sharing of personal information for legal and regulatory purposes. LocalBH ensures that third parties and affiliates adhere to data privacy laws.

c. Consent and Responsibility: With your consent, LocalBH is not responsible for third parties' actions with your data. Efforts are made to secure Customer information and limit its use by third parties. LocalBH does not sell Customers' personal information.

10. Withdrawal of Consent: You can request the deletion of your personal information by contacting LocalBH at [email protected]. Deletion may take up to 7 business days, excluding aggregated or de-identified data. Note that deletion requests may affect service provision, and legal rights are reserved.

11. Exceptions and Deactivation: Exceptions to deletion requests may occur due to completed financial orders or successful transactions. Deactivation requests, disallowing further information use, can be made by contacting [email protected]

12. Updating Your Information: Personal information updates can be done via your LocalBH account on the website. LocalBH shares updates with third parties and affiliates if information remains necessary for the stated purposes.

13. Accessing Your Information: To view or inquire about your personal information, contact LocalBH at [email protected]. A reasonable administrative fee may apply for retrieving personal information records. Account holders can access order details through the website, maintaining confidentiality per the Terms of Conditions. LocalBH disclaims liability for misuse of account details except as outlined in the Terms and Conditons.
